These Terms of Use ("Terms") govern your access to and use of the website located at achour-healthcare-growth-advisors-llc.com (the "Site"), owned and operated by Achour Healthcare Growth Advisors LLC, a Florida limited liability company ("Company," "we," "us," or "our"). By accessing or using the Site, you agree to be bound by these Terms. If you do not agree to these Terms, do not access or use the Site.
1. Description of the Site
The Site provides information about the Company's strategic consulting services for healthcare practices (the "Services") and enables users to submit payments for the Services. The Site is informational in nature and is not intended to be used to deliver the Services themselves. Use of the Site, submission of inquiries through the Site, or submission of payments through the Site does not create a consulting, advisory, or professional services relationship between you and the Company. A consulting relationship is formed only through execution of a separate written services agreement between you and the Company.

The Site is intended for use by authorized representatives of healthcare practices and other business entities seeking information about or purchasing the Services. By using the Site, you represent and warrant that you are at least 18 years of age and have the legal authority to bind the entity on whose behalf you are acting to these Terms.

4. Payments
4.1 Payment Processing. The Site allows you to submit payments for the Services using a third-party payment processor. All payments are subject to the terms and conditions of the applicable payment processor. We are not responsible for any errors, delays, or failures caused by the payment processor.
4.2 Fees. All fees for the Services are as set forth on the Site or in a separate written agreement between you and the Company. Where a services agreement or statement of work governs the Services, the payment terms in that agreement control. Payments submitted through the Site are processed on behalf of the Company but do not modify or replace the terms of any executed consulting agreement. Unless otherwise stated in writing, all fees are quoted in U.S. dollars and are non-refundable.
4.3 Taxes. You are responsible for all applicable taxes associated with your purchase of the Services, excluding taxes based on the Company's net income.
5. Intellectual Property
All content on the Site, including text, graphics, logos, images, and software (collectively, "Content"), is the property of the Company or its licensors and is protected by applicable intellectual property laws. You may not reproduce, distribute, modify, create derivative works of, publicly display, or otherwise exploit any Content without our prior written consent. You represent and warrant that you have the legal right to submit such information and that submission of such information does not violate any applicable law or contractual obligation.
7. Disclaimers
7.1 No Medical or Clinical Advice. The Content on the Site relates solely to strategic business consulting for healthcare practices. Nothing on the Site constitutes medical advice, clinical guidance, diagnosis, or treatment recommendations. The Site is not intended to replace the professional judgment of licensed healthcare providers, and no physician-patient or clinical advisory relationship is created through use of the Site.

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT WILL THE COMPANY, ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, OR LICENSORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, USE, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR ACCESS TO OR USE OF (OR INABILITY TO ACCESS OR USE) THE SITE, WHETHER BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE), STATUTE, OR ANY OTHER LEGAL THEORY, EVEN IF THE COMPANY HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. IN NO EVENT WILL THE COMPANY'S TOTAL AGGREGATE LIABILITY ARISING OUT OF OR IN CONNECTION WITH THESE TERMS OR YOUR USE OF THE SITE EXCEED THE GREATER OF (A) THE AMOUNTS YOU HAVE PAID TO THE COMPANY THROUGH THE SITE IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM OR (B) ONE HUNDRED DOLLARS ($100.00).

Any dispute arising out of or relating to these Terms or the Site shall be brought exclusively in the state or federal courts located in Palm Beach County, Florida, and you consent to the personal jurisdiction of such courts.

15.1 Entire Agreement. These Terms, together with the Privacy Policy and any other agreements referenced herein, constitute the entire agreement between you and the Company regarding the Site.
15.2 Severability. If any provision of these Terms is held to be invalid or unenforceable, that provision will be enforced to the maximum extent permissible, and the remaining provisions will remain in full force and effect.
15.3 Waiver. The Company's failure to enforce any right or provision of these Terms will not be deemed a waiver of that right or provision.
15.4 Assignment. You may not assign or transfer these Terms or your rights hereunder without our prior written consent. The Company may assign these Terms without restriction.
